Terms of Service

Welcome to nzoey! These Terms of Service ("Terms") govern your access to and use of the applications and related services (the "Service") provided by nzoey ("Company", "we", "us", or "our").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Description of Service (AI Specifics)

  1. nzoey is an interactive platform that allows users to create and interact with virtual personas (characters) based on artificial intelligence (AI) technology.
  2. Inherent Imperfection of AI: All responses and content generated by AI characters are automated and do not reflect the opinions or facts of actual humans. AI may generate inaccurate, incomplete, or inappropriate information. You should not rely on AI outputs for critical decisions, and the Company is not liable for any damages arising from such reliance.

2. Eligibility and Accounts

  1. Age Requirement: You must be at least 14 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If we discover a user under the minimum age, we will terminate the account immediately.
  2. Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials. You may not lease or transfer your account to others, and you are solely responsible for all activities that occur under your account.

3. User-Generated Content (UGC)

  1. Ownership: In principle, you retain copyright ownership of the character settings, prompts, and conversation content you create within the Service ("UGC").
  2. License Grant: By creating UGC, you grant us a worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, and distribute your UGC for the purposes of operating, promoting, and training/improving our AI models.
  3. Continuity of Public Characters (Critical): Characters set to 'Public' may remain on the Service and be managed by the Company even after you delete your account to ensure service continuity for other users who have interacted with them.
  4. Prohibited Content: You may not create or distribute content that is obscene, violent, defamatory, or infringes on intellectual property rights. Violating content may be removed without prior notice.

4. Paid Services and Virtual Goods

  1. Nature of Goods: 'Credits (Diamonds)' and 'Subscriptions (Pro)' are licenses to use specific features and have no monetary value. They cannot be refunded for cash or traded outside the Service.
  2. Refund Policy: Due to the nature of digital content, refunds for activated or consumed goods are generally not provided, except as required by law or platform policies (Apple/Google).
  3. Loss of Assets: Upon account deletion, all remaining virtual goods will expire, and the Company has no obligation to compensate for them.

5. Prohibited Conduct

You agree not to:

  1. Hack, data-mine, or attempt to exploit vulnerabilities in the Service.
  2. Attempt to bypass AI safety filters (Jailbreaking) or inject malicious prompts.
  3. Use automated means (bots, scripts) to access the Service.
  4. Impersonate others or spread misinformation.

6. Disclaimers and Limitation of Liability (Defense Clause)

  1. No Warranty: THE SERVICE AND AI OUTPUTS ARE PROVIDED "AS IS." WE DO NOT WARRANT THE LEGALITY, ACCURACY, OR SAFETY OF AI-GENERATED CONTENT.
  2. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  3. Force Majeure: We are not liable for failures or delays caused by events beyond our control, such as natural disasters, war, or national telecommunication outages.

7. Governing Law and Jurisdiction

  1. These Terms are governed by the laws of the Republic of Korea.
  2. Any dispute between the Company and the user shall be submitted to the competent court having jurisdiction over the location of the Company's headquarters.

8. App Store Specific Terms (Apple iOS Devices)

If you download the Service (App) from the Apple App Store, the following additional terms apply:

  1. Acknowledgment: You and the Company acknowledge that these Terms are concluded between you and the Company only, and not with Apple. The Company, not Apple, is solely responsible for the App and its content.

  2. Scope of License: The license granted to you for the App is a limited, non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

  3. Maintenance and Support: The Company is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance and support services.

  4. Warranty and Product Claims: Apple is not responsible for any product warranties, whether express or implied by law. The Company, not Apple, is responsible for addressing any claims of the end-user or any third party relating to the App.

  5. Intellectual Property Rights: In the event of any third-party claim that the App infringes that third partyโ€™s intellectual property rights, the Company, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

  6. Third-Party Beneficiary: Apple, and Appleโ€™s subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
